- GENERAL AND DEFINITIONS
1.1 These terms and conditions (“Terms”) are an agreement between an Authenticated
User (Authenticated User) also as an End-User and VENDBOUT (reg. 02-0102334), an
enterprise incorporated under the laws of India with the trade name (“vendbout”).
vendbout provides services through mobile applications including a web application, with
a communication platform for live services to an online audience. We are customer
friendly cloud based locked data base interactive platform where live user time
monetization is possible in which an Authenticated User as a user can define an
Authenticated Users time in terms of value, whether it is utilized by global sales force or
other client customers themselves or whoever in need of an Authenticated Users most
valuable time!
These terms of service shall apply to all Users. “Authenticated User” means an individual
or a company providing live services through the Platform. “End-User” means the
individual or legal entity making use of the live services offered via the Platform.
“vendbout” means the services provided by VENDBOUT on the Platform, including but
not limited to communication services and other features available at any time. “An
Authenticated User” means the End-User. “Platform” means the website
www.vendbout.com , www.vendbout.live or any service websites or app, webapp or any
other medium of usability under vendbout. If an Authenticated User use vendbout as both
an Authenticated User and an End-User, the respective Terms of Services shall apply.
- ACCEPTANCE OF TERMS
2.1 When an Authenticated User click checkbox [“Agreement”] during the registration
process for an account, an Authenticated User agree to these Terms. vendbout reserves
the right to modify these Terms at any time in its sole discretion and will notify an
Authenticated User by e-mail 7 days in advance of any changes taking effect and by
posting the updated Terms on the Platform. An Authenticated Users continued use of the
Service after notification of any changes in Terms constitutes an Authenticated Users
agreement to the updated Terms. If an Authenticated User do not agree to these Terms
or any updated version of the Terms, an Authenticated User may not use “vendbout”.
- THE SERVICE
3.1 The purpose of “vendbout” is to facilitate the connection and interaction between
Authenticated Users and End-Users for video, audio, or other live services. Such live
services are provided via vendbout’s Platform. By using vendbout.com or vendbout.live
or vendbout APP, an Authenticated User can initiate a live service session with an End
User on the Platform. vendbout does not take part in the interaction between the
Authenticated Users and the End-Users except for providing the Platform for searching,
interacting, and communications and for managing payments when required. vendbout is
not an Authenticated User itself – all live services are offered by the Authenticated Users.
3.2 In order to take part of the Authenticated User’s Services an Authenticated User will
have to set up an account with vendbout. vendbout reserves the right, in its sole
discretion, to refuse an Authenticated Users registration of an account and consequently
any use of the platform or application.
3.3 vendbout may provide support to an Authenticated User as provided on the Platform.
3.4 The Authenticated Users may at their sole discretion choose if and what kind of live
services they want to provide to an Authenticated User and how the services are carried
out and will provide its live services under a separate agreement with an Authenticated
User concerning the live service. Agreements between Authenticated User and the End
User regarding the live service and the content thereof are solely between Authenticated
User and the End User. vendbout is not a party to any agreement between End User and
the Authenticated Users. Complaints and issues concerning an Authenticated User’s
services must be resolved directly between an Authenticated User and the Authenticated
User unless both the Authenticated User and End User lodge raise a complaint through
our support email ID (support@vendbout.com) together and acknowledged the issue and
agreed for a resolution without dispute.
3.5 VENDBOUT WILL NOT BE HELD RESPONSIBLE AND EXPRESSLY DISCLAIMS
ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, DEMANDS OR DAMAGES,
DIRECT OR INDIRECT, OF EVERY KIND AND NATURE, ARISING OUT OF OR IN ANY
WAY CONNECTED WITH “VENDBOUT”. AN AUTHENTICATED USER EXPRESSLY
AGREE TO HOLD VENDBOUT HARMLESS FOR ANY CLAIM, CONTROVERSY OR
DAMAGES THAT MAY ARISE FROM ANY DISPUTE BETWEEN AN AUTHENTICATED
USER AND ANY OTHER USER OF THE PLATFORM OR AUTHENTICATED USER.
- PAYMENT AND REFUNDS
4.1 It is free of charge for Authenticated User to search for an End User on the Platform,
but if an Authenticated User want to use the End User’s services an Authenticated User
may be required to pay for the services through our digital medium of coins (odbo – owned
database object). The Bout Price, set by Users choice, will be shown as price per minute
or per session for that specific End User. The total price for Authenticated or End User’s
services will be based on the length or the price of the session. When calling an End User,
an Authenticated User will be asked to expressly authorize charges for selected services.
Payment to the End User for the live services shall be made directly when the user
accepts the call.
VENDBOUT RESERVES THE RIGHT TO CORRECT ANY ERRORS OR MISTAKES
THAT IT MAKES CONCERNING THE RECHARGE OR WITHDRAWAL OR BOUT
INCOME OR EXPENSES THROUGH WALLET, EVEN IF VENDBOUT ALREADY HAS
REQUESTED OR RECEIVED PAYMENT EVEN WHEN BOTH USERS ARE NOT IN
CONSIDERATION OF THE ISSUE OR VICE VERSA.
- TERMINATION OF END-USER’S ACCOUNT
5.1 Authenticated User may at any time terminate their use of vendbout platform and
close an Authenticated Users account with vendbout. These Terms will apply until an
Authenticated Users account has been closed. As a consequence of an Authenticated
Users termination, vendbout will delete all information that can be attributed to an
Authenticated User. Information on how to close an Authenticated Users account can be
found on the Platform.
5.2 VENDBOUT RESERVES THE RIGHT, IN ITS SOLE DISCRETION AND WITHOUT
PRIOR NOTICE, TO TERMINATE AN AUTHENTICATED USERS ACCOUNT AND AN
AUTHENTICATED USER’S ABILITY TO USE VENDBOUT.
5.3 VENDBOUT RESERVES THE RIGHT, AT ITS SOLE DISCRETION AND WITHOUT
PRIOR NOTICE, TO BLOCK BOTH AUTHENTICATED USERS & END-USERS
ANYTIME FROM ACCESSING THE PLATFORM.
5.4 ANY MISUSE OF THE PLATFORM OR ANY OF THE FEATURES OR SERVICES
WILL RESULT IN A DELETED OR BLOCKED ACCOUNT.
- ELIGIBILITY
6.1 vendbout are available only to individuals that can form legally binding contracts under
applicable law. Without limiting the foregoing, vendbout are not available to anyone under
the age of eighteen (18) unless agreed to by a parent or legal guardian. By setting up an
Authenticated-User account, an Authenticated User guarantee that an Authenticated
User are 18 years old or older. vendbout disclaims any liability related to the use of Eagle
by anyone under legal age.
- PRIVACY
7.1 vendbout is committed to maintaining the privacy and security of an Authenticated
Users personal data. vendbout will only use the information an Authenticated User
provide in accordance with its Privacy Policy or such other legislation succeeding the
Indian law. An Authenticated User acknowledge that vendbout may collect and use an
Authenticated Users personal information for the purposes specified in the Privacy Policy.

vendbout is not responsible for the Authenticated User’s processing of the personal data
that an Authenticated User have provided such Authenticated User(s) with and
consequently disclaims all liability in this regard.USER RESPONSIBILITIES
- 8.1 An Authenticated User may use vendbout platform only for such purposes that are
permitted by applicable law or regulation. An Authenticated User undertake to comply
with vendbout´s from time-to-time applicable guidelines and the Terms. An Authenticated
User may not use vendbout in a way that causes vendbout or other third-party harm. If
an Authenticated User become aware of vendbout being used in violation of these
provisions, an Authenticated User shall, if possible, immediately terminate such use and
inform vendbout of the violation.
8.2 An Authenticated Users account is for an Authenticated Users sole, personal use. An
Authenticated User may not authorize others to use an Authenticated Users account and
an Authenticated User may not assign or otherwise transfer an Authenticated Users
account to any other person or entity. An Authenticated User are responsible for
maintaining the confidentiality of an Authenticated Users password to an Authenticated
Users account.
8.3 An Authenticated User agree not to communicate or publish information that infringes
or violates someone else’s right (copyright, trademark or other intellectual property right),
that may violate the integrity of, intimidate or offend another person, which may challenge
criminal actions or contain material not permitted by any applicable law or regulation (for
example discrimination, racial agitation). An Authenticated User may not use any part of
vendbout platform for sending unwanted bulk mail or unrequested marketing e-mails or
conduct an automated process service other than services provided by vendbout.
8.4 An Authenticated Users account is for an Authenticated Users sole, personal use. An
Authenticated User may not authorize others to use an Authenticated Users account and
an Authenticated User may not assign or otherwise transfer an Authenticated Users
account to any other person or entity. An Authenticated User are responsible for
maintaining the confidentiality of an Authenticated Users password to an Authenticated
Users account.
8.5 An Authenticated User are responsible for providing accurate, current and complete
information in connection with an Authenticated Users registration and use of the Platform
and Other Vendbout services. In relation to vendbout and its partners, an Authenticated
User are solely responsible for all information communicated or transmitted through
vendbout and an Authenticated Users account. Information means for example text,
pictures, sounds, data, video and links.
8.6 An Authenticated User may not use the Platform to recruit, solicit, or contact
Authenticated Users for employment or contracting for a business not affiliated with
vendbout.
8.7 An Authenticated User may not copy the contents of vendbout and the Platform,
including but not limited to any of the records or profiles of Authenticated Users and other
users, and an Authenticated User are prohibited from using any technology, method or
scheme to reproduce or mirror all or any portion of the contents of vendbout and the
Platform, nor utilize any other technology, or automated code of any kind, to copy,
reproduce or download the contents of vendbout and the Platform.
8.8 The marks and trademarks “vendbout” and the vendbout logo are marks owned by
vendbout. Except as may be otherwise indicated, any other trademarks, service marks,
logos and/or trade names appearing on the Platform are the properties of their respective
owners. An Authenticated User acknowledge the rights of vendbout and the respective
third parties in those marks and that an Authenticated User may not copy or use any of
these marks, logos or trade names without the prior written permission of the owner. By
posting content to any public or user area of the Platform an Authenticated User
guarantee that an Authenticated User have the right to grant, and an Authenticated User
do grant to vendbout an irrevocable, worldwide license to use, copy, perform, display,
reproduce, adapt, modify and distribute such content and to prepare derivative works of,
or incorporate into other works, such content. An Authenticated User further represent
and warrant that public posting and use of an Authenticated Users content by vendbout
will not infringe or violate the rights of any third party. An Authenticated Users use of
Vendbout.com, including but not limited to the content an Authenticated User post on the
Platform, must be in accordance with any and all applicable laws and regulations.
- NO WARRANTY
9.1 THIS PLATFORM, VENDBOUT, THE INFORMATION AND MATERIALS
CONTAINED AND MADE AVAILABLE THROUGH THIS PLATFORM AND
VENDBOUT.COM VENDBOUT.LIVE OR VENDBOUT APPLICATION, INCLUDING
LIVE SERVICES, TEXT, GRAPHICS, INFORMATION, LINKS OR OTHER ITEMS ARE
ALL PROVIDED “AS IS” AND “AS AVAILABLE”.
9.2 VENDBOUT DOES NOT: a) GUARANTEE, THE ACCURACY, COMPLETENESS
OR USEFULNESS OF ANY INFORMATION PROVIDED ON THE PLATFORM,
THROUGH VENDBOUT.COM OR THROUGH THE AUTHENTICATED OR END
USER’S SERVICES, OR b) ADOPT, ENDORSE OR ACCEPT RESPONSIBILITY FOR
THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE, OR STATEMENT
MADE BY ANY AUTHENTICATED OR END USER THROUGH OR ON OUR
PLATFORM OR THROUGH VENDBOUT AND OTHER SERVICE APPS AND
WEBSITES. VENDBOUT DOES NOT WARRANT THAT AN AUTHENTICATED USERS
USE OF VENDBOUT WILL BE SECURE, UNINTERRUPTED, SAFE, ALWAYS
AVAILABLE, ERROR-FREE OR WILL MEET AN AUTHENTICATED USER’S
REQUIREMENTS, OR THAT ANY DEFECTS IN VENDBOUT WILL BE CORRECTED.
IN ADDITION, VENDBOUT MAKES NO REPRESENTATION OR WARRANTIES OF
ANY KIND WHETHER EXPRESS OR IMPLIED REGARDING THE SUITABILITY AND
CREDENTIALS OF ANY AUTHENTICATED USER.
- LIMITATION OF LIABILITY
10.1 AN AUTHENTICATED USER AGREE THAT NEITHER VENDBOUT NOR THE
AUTHENTICATED OR END USERS WILL BE LIABLE FOR ANY HARMS, WHETHER
DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY
DAMAGES, RESULTING FROM OR RELATING TO: (i) THE USE OR THE INABILITY
TO USE THE PLATFORM OR VENDBOUT; (ii) ADVISE, STATEMENTS OR CONDUCT
OF THE AUTHENTICATED OR END USERS; OR (iii) ANY OTHER MATTER RELATING
TO VENDBOUT.
10.2 AN AUTHENTICATED USER AGREE THAT VENDBOUT’S AGGREGATE
LIABILITY IN RELATION TO AN AUTHENTICATED USER NEVER CAN EXCEED THE
PRICE PAID BY AN AUTHENTICATED USER FOR VENDBOUT. VENDBOUT
EXPRESSLY EXCLUDE ANY AND ALL LIABILITY TO ANY THIRD PARTY.
- INDEMNIFICATION
11.1 AN AUTHENTICATED USER AGREE TO INDEMNIFY, DEFEND AND HOLD
HARMLESS VENDBOUT FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES,
EXPENSES, OR DEMANDS OF LIABILITY, INCLUDING BUT NOT LIMITED TO
REASONABLE ATTORNEYS’S FEES AND COSTS IN CONNECTION WITH ANY
CLAIM ARISING OUT OF AN AUTHENTICATED USERS USE OF THE PLATFORM OR
VENDBOUT APP OR WEBSITES AND AN AUTHENTICATED USERS VIOLATION OF
THESE TERMS.
11.2 AN AUTHENTICATED USER SHALL INDEMNIFY AND HOLD VENDBOUT
HARMLESS FOR ANY CLAIM, CONTROVERSY OR DAMAGES THAT MAY ARISE
FROM ANY DISPUTE BETWEEN AN AUTHENTICATED USER AND ANY OTHER
USER OF THE PLATFORM AND/OR AUTHENTICATED OR/AND ENDUSER.
11.3 AN AUTHENTICATED USER SHALL INDEMNIFY AND HOLD VENDBOUT
HARMLESS FROM ANY DIRECT OR INDIRECT CLAIM MADE BY A THIRD PARTY
ARISING OUT OF AN AUTHENTICATED USERS USE OF VENDBOUT. THIS MEANS
THAT IF AN AUTHENTICATED USER OR SOMEONE ACTING ON AN
AUTHENTICATED USER’S BEHALF SHOULD CAUSE VENDBOUT’S END-USERS OR
A THIRD-PARTY DAMAGE, AN AUTHENTICATED USER SHALL INDEMNIFY AND
HOLD HARMLESS VENDBOUT FROM ANY SUCH CLAIM.
- FORCE MAJEURE
12.1 An Authenticated User expressly release vendbout from responsibility for any delay
or failure of performance if and to the extent caused by an event that is not reasonably
foreseeable or otherwise caused by or under the control of the party claiming force
majeure, such as changes in laws and regulations or in the interpretation thereof, acts of
authorities, war, acts of war, labor disputes, blockades, sabotage, terrorism, vandalism,
accidents and other like events.
- MISCELLANEOUS
13.1 An Authenticated User agree that we may communicate with an Authenticated User
by sending electronic mail to the e-mail address an Authenticated User have registered
with vendbout or by providing information to an Authenticated User through our Platform,
regarding these Terms, Vendbout customer service matters, or any other
communications related to an Authenticated Users use of Vendbout. An Authenticated
User agree to make sure that the e-mail address an Authenticated User have registered
with vendbout is accurate.
13.2 An Authenticated User may not assign or pledge an Authenticated Users rights and
obligations under these Terms to any third party except with the prior written consent of
vendbout. vendbout reserves the right to assign its rights and obligations under these
Terms without notice to an Authenticated User or an Authenticated Users consent.
13.3 The failure of vendbout to exercise or enforce any right or provision of these Terms
shall not constitute a waiver of such right or provision. If any provision of these Terms is
found to be unenforceable or invalid by a court of competent jurisdiction, that provision
shall be limited or eliminated to the minimum extent necessary, and the Terms shall
otherwise remain in full force and effect and remain enforceable between the parties.
13.4 The contents of these Terms shall supersede all previous written or oral
commitments and undertakings.
13.5 This Agreement shall be construed in accordance with and be governed by the laws
of India, without regard to its conflict of law provisions.
13.6 Any dispute, controversy or claim arising out of or in connection with these Terms
shall be finally settled by Indian courts, with Kerala High Court as the court of first
instance.
A. OTHER GENERAL AND DEFINITIONS
Words written with capital letters in this Privacy Policy has the same meaning as
expressed in the relevant Terms of Service. Authenticated Users and End-Users will be
jointly referred to as “User” in this document. vendbout will process an Authenticated
Users personal data in compliance with the Indian IT Act or any such succeeding
legislation and this Privacy Policy. vendbout is the personal data controller in accordance
with the act regarding the opening of User accounts. However, each account holder is the
respective personal data controller in regard to personal data in live service sessions or
other communication between Users. vendbout has composed this Privacy Policy in order
to inform Users about our undertakings to protect the personal data we have been
provided with on the Platform. The Policy is not applicable to other information or
websites. We encourage an Authenticated User to regularly visit the Privacy Policy as it
may get updated from time to time.
B. PERSONAL DATA
vendbout collects information which an Authenticated User provide directly to us, such as
when an Authenticated User create or modify an Authenticated Users account, request
on-demand services, contact customer support, or otherwise communicate with us. This
information may include name, email, password, phone number, profile picture, and other
information which an Authenticated User choose to provide. vendbout will keep all
personal data confidential. An Authenticated User decide which personal data an
Authenticated User wish to submit on the Platform. vendbout collects the User´s personal
data for purposes relating to the registration and opening of new User Accounts, and to
provide and maintain Vendbout platform. Personal data may also be used for market
analysis, development and improvement of Vendbout and for statistical purposes. When
an End-User wishes to use a fee-based live service, or pay for recharge of odbo coins,
payment details will be collected by the third-party appointed by vendbout to perform
payments services, currently Razorpay & PayPal. They may use an Authenticated Users
Payment Information in accordance with their own Privacy Policy. Personal data will only
be requested to the extent necessary in order to perform payment services. To better
understand, protect and meet the demands and expectations of our Users, we also
automatically collect data relating to how the User uses vendbout app and the Platform.
This information is collected for vendbout’s internal research regarding our user’s
preferences and behavior. The data collected may include the User´s web browser and
IP-address. vendbout may also receive information from other sources. For example,
when Users interact in a live service session, the End-user may provide vendbout with a
rating on the Authenticated User’s service, and vice versa. As a User, an Authenticated
User acknowledge that personal data submitted during live service sessions might be
stored and processed by the other User in that specific live service session. vendbout is
not liable for such personal data. vendbout takes all reasonable steps to ensure that an
Authenticated Users personal data is correct and up to date. If an Authenticated User
believe that an Authenticated Users personal data stored by vendbout is incorrect, an
Authenticated User shall notify vendbout and provide it with correct data in order to rectify
and update an Authenticated Users personal data. An Authenticated User can also
correct and update the personal data provided by an Authenticated User directly on the
Platform. vendbout may be required by law to disclose certain information regarding its
Users to a third party or a regulatory authority. vendbout is currently hosting vendbout
app and websites and the Platform in the EU/EES and personal data will be stored in the
EU/EES. vendbout does not request the submission of sensitive personal data. However,
if the user on his/her own initiative and risk discloses personal data revealing race, ethnic
origin, political opinion, religious or philosophical beliefs or membership of a trade union,
vendbout will process such personal data only as part of the vendbout services to that
User.
C. SELF-MONITORING
It is of utmost importance for vendbout to protect its Users´ integrity. However, the User
bears the sole responsibility and takes on all the risks associated with using vendbout
and the Platform, internet in general, posting or participating in live service sessions on
vendbout and the Platform, as well as how the User interacts on or outside the Platform.
D. COOKIES
vendbout uses cookies in order to enhance and facilitate the user experience. A cookie
is a small text file that contains text information and is saved on the User´s computer or
mobile. A cookie is used in order to improve the user experience when using vendbout
app or website and the Platform, and also to create statistics regarding Users´ use of the
Platform. Consequently, by allowing cookies, the User will be able to keep its preferences
as it uses the Services. Cookies also allow for vendbout to offer secure webpages without
the User having to log in again each time. In order to not accept cookies, the User may
adjust its web browser settings either to not accept cookies or to indicate when a cookie
is used. However, vendbout.com or vendbout.live or vendbout app or platform may
require the use of cookies in order to function as intended.
E. RIGHT TO OBTAIN INFORMATION
Once per calendar year, an Authenticated User are entitled to obtain information about
an Authenticated Users personal data stored and handled by vendbout at no cost. The
request must be in writing and addressed to vendbout, on the address below, and must
be signed by an Authenticated User.
F. RIGHT TO DELETE DATA
An Authenticated User have the right to request deletion of an Authenticated Users data
by a request through mail from an Authenticated Users authorized mail id and that will
comply a verification process and approval from our technical team is needed.
G. USER GENERATED CONTENT
WE CONSIDER “USER-GENERATED CONTENT” TO BE MATERIALS (TEXT, IMAGE
AND/OR VIDEO CONTENT) VOLUNTARILY SUPPLIED TO US BY OUR USERS FOR
THE PURPOSE OF PUBLICATION ON OUR WEBSITE OR RE-PUBLISHING ON OUR
SOCIAL MEDIA CHANNELS. ALL USER-GENERATED CONTENT IS ASSOCIATED
WITH THE ACCOUNT OR EMAIL ADDRESS USED TO SUBMIT THE
MATERIALS.PLEASE BE AWARE THAT ANY CONTENT AN AUTHENTICATED USER
SUBMIT FOR THE PURPOSE OF PUBLICATION WILL BE PUBLIC AFTER POSTING
(AND SUBSEQUENT REVIEW OR VETTING PROCESS). ONCE PUBLISHED, IT MAY
BE ACCESSIBLE TO THIRD PARTIES NOT COVERED UNDER THIS POLICY
DOCUMENT AND THE AUTHENTICATED USER WHO HAS POSTED THE CONTENT
IS THE SOLE RESPONSIBLE OR LIABLE PERSON FOR ANY DAMAGES, OR ISSUES
RELATED TOP THE POST AND WE HAVE EVERY RIGHT TO REVOKE OR
UNPUBLISH THE POST OR ANY TOPIC AND TO BLOCK OR TERMINATE THE
AUTHOR AT ANYTIME AND ITS SOLE DISCRETION OF VENDBOUT.
G.1 TOPIC OR POST OR COMMENT RULES
- Abusive or disrespectful talks or chats or words are strictly prohibited.
*Pornography, nudity, depictions of rape, incest, bestiality, or any other adult or obscene
content including implied, suggested or censored in any form such as: imagery (including
illustrative), videos, links to or from external sites or content containing such material,
Sexual services such as prostitution, escorts, pay-per-view, or adult live chat features are
banned and strictly prohibited, In such cases your account will be unrecoverably blocked.
*Any activity that violates any law or governmental regulation industry requirements or
money laundering regulation. Hate speech, intimidation, or abuse of any kind targeting
any individual, group, or institution, Funding a ransom, human trafficking or exploitation,
vigilantism, bribes or bounty, Products or services that directly infringe or facilitate
infringement upon the trademark, patent, copyright, trade secrets, or proprietary or
privacy rights of any third party, Content including links to and from the platform which is
fraudulent, misleading, inaccurate or dishonest, Transactions for the sale of items, goods
or services including digital downloads with the purpose of avoiding paying taxes, All
above mentioned are strictly prohibited and we have every right to take action again the
committing user under governing law.
G.2 COMMUNICATION BETWEEN USERS
All communications between Authenticated User and End User through VENDBOUT’s
Platform, Websites or Applications are end to end encrypted and vendbout has no
interference in such activities. Vendbout is just a medium which facilitates the
communication and all the related issues and disputes are generally out of our control.
VENDBOUT IS NOT LIABLE FOR ANY LOSS OR ISSUES OR DISPUTES BETWEEN
AUTHENTICATED USER AND END USER, WE RECOMMEND ALL OUR USERS TO

PERSONAL INFORMATIONS WHICH MAY CAUSE LOSSES TO BOTH USERS AND
VENDBOUT WILL NOT BE LIABLE FOR ANY LOSSES THAT MAY HAPPEN AND NO
CLAIMS CAN BE CHARGED AGAINST VENDBOUT IN ANY COURT OF LAW.
H. CALL RULES
*Authenticated User (You) and End User (Receiver) have equal rights to disconnect the
call any moment even before the session time ends.
*Even after the session time is out, the cloud calling will continue without interruption for
ensuring the continuity of the conversation until any of the user disconnect the connection
& that is completely based on the decision of the Receiver.
- Abusive or disrespectful talks or chats or words are strictly prohibited.
*Pornography, nudity, depictions of rape, incest, bestiality, or any other adult or obscene
content including implied, suggested or censored in any form such as: imagery (including
illustrative), videos, links to or from external sites or content containing such material,
Sexual services such as prostitution, escorts, pay-per-view, or adult live chat features are
banned and strictly prohibited, In such cases your account will be unrecoverably blocked.
*Any activity that violates any law or governmental regulation industry requirements or
money laundering regulation. Hate speech, intimidation, or abuse of any kind targeting
any individual, group, or institution, Funding a ransom, human trafficking or exploitation,
vigilantism, bribes or bounty, Products or services that directly infringe or facilitate
infringement upon the trademark, patent, copyright, trade secrets, or proprietary or
privacy rights of any third party, Content including links to and from the platform which is
fraudulent, misleading, inaccurate or dishonest, Transactions for the sale of items, goods
or services including digital downloads with the purpose of avoiding paying taxes, All
above mentioned are strictly prohibited and we have every right to take action again the
committing user under governing law.
- You (Authenticated User) will be charged based on bout price & session from your
wallet.
*You (Authenticated User) will only be charged If the end user accepts your call. Also End
User will only receive the Bout income of the corresponding call only if they accept the
call.
- If the receiver has accepted the call and the deduction or addition is triggered, then no
refunds or disputes are entertained until there is a valid reason which both Authenticated
& End User mutually agrees & acknowledge the same.
*User automatically agrees to calling rules while using this platform by default while
signing in or creating account with vendbout.
I. RECHARGE & WITHDRAWAL RULES
- Recharge and Withdrawals are done by third party service providers (banks & payment
gateways)
*The time period for processing such transactions are subject to change in some
circumstances & based on Authenticated Users bank, country, currency & details user
have provided.
*Normally it might take 15 to 30 minutes for a recharge to get reflected & withdrawals are
processed based on below:
Basic Plan: 5th of Every Month
Active Plan: 15th & 30th of Every Month
Special Plan: 10th, 20th & 30th of Every Month
Premium Plan: Monday of Every Week
*For withdrawal it can take up to 7 to 15 days to reflect in the Authenticated users bank
account, once the withdrawal is prompted by the Authenticated User and it is done
manually after a verification audit done by our internal team.
VENDBOUT IS NOT LIABLE FOR ANY LOSS OR DAMAGE CAUSED DURING
RECHARGES AND WITHDRAWALS INITIATED BY AUTHENTICATED USER AND IF
THERE IS A DISPUTE UNDER INDIAN COURT OF LAW AN AUTHENTICATED USER
CANNOT CLAIM NOT MORE THAN THE PARTICULARLY DISPUTED RECHARGE
AMOUNT OR WITHDRAWAL AMOUNT.
J. MEMBERSHIP RULES
In BASIC FREE Plan, we charge 40% of user’s bout income. A user can reduce this by
changing their plan to ACTIVE, SPECIAL or PREMIUM with a one-time fee.
A verification process will be initiated while a user changes the plan, and the membership
rules are as follows:
*Verification is a manual process & completion may take up to 15 to 30 days.
*Gold badges will be delivered to users’ profile only after the verification process is
completed & successful.
*Admin fee percentage as per users selected plan will be activated only after the
verification process is completed & successful.
*Editing of profile information as per user’s plan can be done anytime, but they have to
make sure that the details given are correct & duly checked.
*All other features based on users selected plan will be activated only when the
verification process is completed.
*If users are choosing a plan now, you can still upgrade to higher plans any time only
through the same normal process and new verification process will be initiated & upon
successful completion of verification, 50% of Previous Plan Fee will be refunded to the
wallet. THIS IS APPLICABLE ONLY FOR UPGRADATION OF MEMBERSHIP.
*No refunds will be provided for any other circumstances such as cancellations of your
subscription or deletion of your account or non-usage of the platform or unsuccessful
verification or any reason.
*Users will need to share your Aadhaar Card or Passport Copy or any other Govt Photo
ID.
*At least 2 prominent social media profile links have to be provided.
*In case of Trusted Business Plan, you will need to share your valid company license &
working website URL with contact details.
*A selfie photo with your photo ID should be shared in which your Face & ID must be
verifiably visible.
*User may or may not receive audio or video calls from us if it is a requirement for the
procedure to be completed.
